Definitions |
| 1.1 |
BBA: Bols Bartending Academy, part of Lucas Bols B.V. |
| 1.2 |
Course Applicant: A person who has applied for one or more courses offered by the BBA. |
| 1.3 |
Course Participant: A person who has been admitted to a course of the BBA. |
| 1.4 |
General terms: these General Terms of Registration and Course Conditions. |

| 2. |
Range of application of the General Terms |
| 2.1 |
These terms are applicable to all courses provided by the BBA. |
| 2.2 |
By submitting the application form, the Course Applicant agrees to the applicability of these General Terms. |

| 3. |
Application |
| |
Application for one or more courses can be made by filling in completely the on-line BBA application form. The BBA will confirm the receipt of the application by e-mail to the e-mail address of the Course Applicant. |

| 4. |
Placement |
| 4.1 |
If the number of applications received by the BBA for a particular course exceeds the maximal number of participants, selection is made on a first-come, first-served basis. |
| 4.2 |
A Course Applicant who is not selected will be notified by e-mail. |
| 4.3 |
A Course Applicant who has made a booking by e-mail, accompanied by an invitation to pay the course fee. |

| 5. |
Payment |
| |
The course fee can only be paid at least seven days before the start of the course by means of a credit card or I-deal. |

|
| 6. |
Liability |
| 6.1 |
The BBA accepts no liability whatsoever, unless for situations in which its liability insurance provides for an insurance payment, which amount, increased by the amount of the excess according to the policy in questions, will be the maximum compensation to be paid to the aggrieved Course Participant. |
| 6.2 |
If and in so far as no payment takes place pursuant to the insurance policy referred to in the previous article for reasons outside the specific circumstances of the relevant case of damage, any liability on the part of the BBA is limited to a maximum of € 10.000,-- under any conditions whatsoever. |
| 6.3 |
The BBA is not liable for any shortcomings of third parties hired to work for the BBA. |

| 7. |
Cancellation |
| 7.1 |
Cancellation of participation in a course can only be made in writing. |
| 7.2 |
If the cancelation is made no later than thirty one (31) days before the commencement of the course concerned, 15% administrative expenses will be deducted form the course fee to be refunded. |
| 7.3 |
If the cancelation is made later than thirty one (31) days before commencement of the course concerned, the course participant is not entitled to a refund of the course fee. The Course Participant may allow another participant to take his or her place, provided he/she informs the BBA of this in writing at least one week before commencement of the course. |
| 7.4 |
The BBA retains the right to cancel a course if there are not enough applicants, without in any way compensation. In such a case the BBA will inform the course participant (in writing) as soon as possible and will repay the course fee if it has already been paid. |

| 8. |
Miscellaneous |
| 8.1 |
The BBA is not responsible for statements by and/or the behavior of BBA-trainers and/or Course Participants towards one another. Nor is the BBA liable for any injury caused by BBA-trainers, materials or aids, except in the case of deliberate intent or gross negligence on the part of the BBA. |
| 8.2 |
The BBA is not liable for the disappearance of the Course Participants’ possessions through theft or loss. |
| 8.3 |
The BBA retains the right to deny a Course Participant further admission to a course if the Course Participants’ behavior, in the opinion of the BBA-trainer, prevents the course from proceeding properly. In such a case the Course Participant has no entitlement to a refund of the course fee. |
| 8.4 |
The Course Participant is not allowed to publish the course methodology and/or course material in whole or in part and/or to reproduce it except for personal use. |

| 9. |
Use of information |
| 9.1 |
The BBA is entitled to process and use the information submitted on the on-line BBA application form:
- to accept or refuse the application;
- if the application has been accepted, to execute the agreement with the Course Participant;
- to inform the relevant Course Applicant or Participant of other products or services by the BBA and or/ Lucas Bols.

| 9.2 |
The BBA does not sell, or lease its lists of Course Applicants or Participants to third parties. |

| 10. |
Disputes |
| |
Any disputes that may arise between the Course Participant and the BBA, that cannot be settled amicably, will be submitted to the competent court in Amsterdam, The Netherlands. Dutch law will be applicable. |
